Lead Paint in NYC Apartments: What You Need to Know

Lead paint is a real and regulated issue in New York City's older housing stock. Most pre-war and early post-war apartment buildings — constructed before 1978 — have lead paint somewhere. Understanding the regulations, your responsibilities, and how to work safely with it protects both your family and your renovation project.

NYC Lead Paint Regulations

New York City Local Law 1 requires that owners of pre-1960 buildings (and pre-1978 buildings where children under six reside) maintain lead paint in good condition and address peeling, chipping, or deteriorating lead paint. The law also requires specific work practices for renovation, repair, and painting (RRP) activities that disturb lead paint surfaces.

EPA RRP Rule

The Federal EPA Renovation, Repair, and Painting (RRP) Rule requires that contractors performing renovation work in pre-1978 homes, apartments, and child-occupied facilities use lead-safe work practices and be certified by an EPA-accredited program. Ask any contractor you're considering whether they are EPA RRP certified — if they're working on a pre-1978 building, they're required to be.

Lead Paint Testing

You can test for lead paint yourself with XRF testing (a professional service using an X-ray device that provides instant, non-destructive results) or with swab test kits (less accurate but affordable). Testing before any renovation work in a pre-1978 apartment is strongly recommended.

Working Safely in the Presence of Lead Paint

Lead-safe renovation doesn't always mean lead removal (abatement). Containment and encapsulation — sealing lead paint in good condition under new paint — is an EPA-approved approach for disturbing small areas. Large-scale lead abatement requires a licensed abatement contractor and additional regulatory compliance. For most NYC apartment painting projects, lead-safe work practice compliance (proper containment, HEPA vacuuming, wet methods) is the appropriate standard.
